Terms of use

These terms apply to the TMassist walkaround check app and the TMassist compliance portal, both provided by Logistics Training (UK) Ltd. By using either, you accept them.

What this is, and what it is not

TMassist is two things together: a dashboard that holds the records behind your operation, and a service in which a qualified transport manager reviews those records and advises you on them. Your drivers use apps for walkaround checks and tachograph downloads, and that data feeds the dashboard.

We monitor and interpret records, reports and data. We do not physically inspect your vehicles. Where we comment on a defect, a safety inspection or a brake test, we are reviewing the report of it, not carrying out the examination ourselves.

Responsibility stays with you, and this is not a formality. On a restricted licence you are the responsible person and you remain liable to the DVSA and the Traffic Commissioner. We advise; we do not assume your legal duty, and nobody can sell you an arrangement that transfers it. Our advice, our flags and anything produced by the dashboard's question-and-answer features are not legal advice.

Nor do we decide whether a vehicle is fit to be on the road. That judgement is the driver's and the operator's at the time of use.

Our review depends on what reaches us. If checks are not filed, tachograph data is not downloaded, or documents are not uploaded, there is nothing for us to review — and an absence of flags from us does not mean an absence of problems.

The default checklist follows current DVSA guidance as we understand it. Guidance changes, and you are free to add or hide items — so check that what your drivers are asked matches what your own systems and your licence undertakings require.

Your account

• Keep your password to yourself. A walkaround check is signed evidence, and it is worth very little if somebody else could have signed it.
• Where you invite drivers with a join code, only give it to people you intend to have access to your fleet's records, and revoke it when you are done with it.
• You are responsible for what is filed under your account, and for the accuracy of what you record.
• Do not use the service unlawfully, try to reach data belonging to another operator, or attempt to interfere with how it works.

The free app and the paid dashboard

The walkaround check app is free to use, and a free account gets no transport manager review — there is no subscription for that review to sit under.

The dashboard and the transport manager service are a paid subscription, priced per vehicle per month: £100 for your first vehicle and £20 for each additional vehicle. Billing period and cancellation terms are those shown to you when you subscribe.

We may change what the free app includes. We will not do so in a way that takes away access to checks you have already filed.

Availability

We aim to keep the service running but cannot promise it will never be unavailable. The app holds a check on your phone when it cannot reach us and files it when it can, so a connection problem does not stop you completing a check — but you should satisfy yourself that a check has been filed where it matters to you.

Keep your own copy of anything you cannot afford to lose. Completed checks are emailed to you as attachments partly for this reason.

Our liability

We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.

Otherwise, and because the free app is provided at no charge, we are not liable for indirect or consequential loss, for loss of profit or business, or for any regulatory penalty, prohibition or licence action arising from your use of the service. Where you pay for the portal, our total liability is limited to the fees you paid in the 12 months before the claim.

Ending it

You can stop using the service at any time and ask us to close your account — see our privacy notice for how. We may suspend or close an account that breaches these terms, and will tell you why unless we are prevented from doing so.

Changes and governing law

We may update these terms; the date at the top shows when they last changed, and material changes will be notified rather than left here to be discovered. These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
